Arrival.Space – General Terms and Conditions for Guests

1. Scope

These Terms and Conditions for Guest Users (“Guest Terms”) govern access to and use of Arrival.Space by persons who visit, explore or interact with spaces without creating a registered account (“Guest”, “you”). The Platform is operated by Stratum1 GmbH (“Stratum1”, “we”, “us” or “our”).

By accessing or using Arrival.Space as a Guest, you agree to these Guest Terms. If you do not agree, you may not use the Platform.

Registered users are subject to the Terms and Conditions for Registered Users. If you decide to create an account, the registered-user terms apply.

2. Guest access, limited functionality, registration

Guest access is limited. Depending on the space and configuration, Guests may be able to:

• enter a public, shared, link-only or password-protected space;
• choose or enter a nickname or username;
• appear through a guest avatar;
• move through and explore the space;
• see public content, other users, avatars and interactions;
• use voice, chat or communication features where enabled;
• interact with Gates or external content where activated;
• submit reports or feedback.

Guest access does not include full account functionality such as creating persistent spaces, uploading or creating content, publishing content, using free or paid features, collaborating with others, or controlling account-level settings unless expressly enabled. 

For full functionality or to subscribe to a paid plan, you need to create an account. If you decide to register, we will ask you for personal information to identify you on the Platform. We will keep this information accurate and up to date.

We may restrict, change or discontinue Guest access at any time for security, legal, technical, product or business reasons.

3. Age and lawful use

The Platform is not intended for individuals under 14 years of age unless use is lawful and supervised by a parent or legal guardian. Certain features may require a higher age or may be unavailable to Guests.

4. Conduct rules

You agree to use our Platform only for lawful purposes and in accordance with these Terms.

You agree to not:

• use the Platform unlawfully or in a way that violates third-party rights;
• infringes on patents, trademarks, copyrights, proprietary rights, or confidential information
• harass, threaten, abuse, impersonate, mislead, defraud or spam other users;
• use offensive, discriminatory, defamatory, violent, sexually exploitative or illegal names, speech or behaviour;
• interfere with Platform operation, security, performance, availability  or violates these Terms;
• attempt to bypass access controls, privacy settings, passwords, security restrictions or technical limits;
• upload, transmit, speak, display or link unlawful or infringing content;
• collect personal data of other users unlawfully;
• use the Platform for malware, phishing, scraping, surveillance, hidden tracking or similar abuse.

We may remove, restrict, mute, block or suspend Guest access where we reasonably believe these Guest Terms are violated or where necessary to protect users, third-party rights, security or legal compliance.

5. Guest communications, voice and microphone use

Some spaces may allow Guests to communicate through voice, chat, audio, video or similar real-time features. Such features may require browser or device permissions, including microphone access.

If you enable microphone or voice features, your audio and related technical data may be processed in real time to provide the communication feature. Other users in the same space may hear you. Do not share personal, confidential or sensitive information unless you intend others in that space to receive it.

You are responsible for your speech, sounds, chat messages, conduct and interactions. We may process communication-related technical data for security, abuse prevention, service operation and troubleshooting as described in the Privacy Policy.

6. User-generated content and visible information

As a Guest, your nickname, avatar, movement, presence, interactions, chat, voice or other activity may be visible to other users in the same space by design. The exact visibility depends on the space configuration and features used.

You do not obtain any ownership rights in the Platform or in content made available by registered users, creators or Stratum1. You may access such content only through the Platform and only as permitted by the relevant space settings and these Guest Terms.

You must not copy, scrape, download, record, reproduce, redistribute, modify or commercially exploit spaces, content, avatars, media, designs, assets or interactions unless you have permission from the relevant rights holder.

7. External content and Gates

Creators may embed or link external content within spaces through “Gates” or similar features. Gates may include websites, media, videos, social media posts, interactive content, iframes, tools or external platforms.

We do not control or review all third-party content, including but not limited to, video and social media platforms provided by creators. Such content is only loaded after you actively interact with a Gate or have accepted the relevant external media setting. Once activated, data may be transmitted to the respective external platform, which is responsible for its own data processing practices unless expressly stated otherwise.

If you accept external services in the cookie or privacy settings, manual consent may no longer be required each time you access such content, subject to your selected setting.

Registered Creators are responsible for any content they upload, distribute, or publish on the Platform and warrant that they hold all rights to their User Content and that it does not violate applicable laws or these our Terms. 

We do not guarantee that external content is lawful, available, secure, accurate or privacy-preserving. Use external content at your own risk.

We are under no obligation to monitor or actively seek out illegal content. We reserve the right to remove User Content that violates these Terms or applicable law.

8. AI, automated and interactive features

Some spaces may include AI-assisted, automated, prompt-based or vibe-based functionality. Guest access to such features may be limited.

AI or automated outputs may be inaccurate, incomplete, unexpected, unsafe or unsuitable. Do not rely on them as professional advice. You are responsible for your interactions with such features.

9. Reporting illegal content or abuse

You may report illegal content, rights violations, abuse or violations of these Guest Terms via our Notice and Action Mechanism or by contacting us at office@stratum1.io.

A “Report” button is available in the user interface. Reports should include a clear description of the issue, the location of the content or space, your contact details where required, and a good-faith statement that the information provided is accurate.

We will acknowledge receipt and process reports within 14 business days. If we restrict or remove content or accounts, we will provide specific reasons to the affected user or notify competent authorities where required or appropriate.

10. Security and Data protection 

We take reasonable measures to protect data and access. Our Privacy Policy explains how we process personal data, including Guest interaction data, technical data, voice-related data, reports, cookie choices and data processed.

Optional cookies, analytics, marketing or external media services are used only where permitted by law and according to your choices. Necessary technologies may be used to provide the Platform, security and requested features.

Users must create strong passwords and keep them confidential. If compromised, you must change your password immediately and notify us. You are responsible for all activities under your account. 

11. Availability and changes

We aim to provide reliable access but do not guarantee uninterrupted availability. Access may be interrupted by maintenance, updates, security measures, network issues, third-party services, technical failures or circumstances outside our control.

We may update, modify, restrict or discontinue Guest functionality at any time.

12. Intellectual Property Rights 

All Platform content and materials (including logo, texts, graphics, and images) are our intellectual property and protected by law.

We grant you a non-exclusive, non-transferable, limited license to access and use the Platform for personal or business purposes, subject to these Terms.

You may not copy, modify, distribute, sell, or sublicense any part of the Platform without written consent.

User Content remains the property of the user. By creating a public or remixable space or content, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, perpetual, worldwide license to use it in connection with the Platform. Further non-public space settings (e.g. link-only, password-protected) and licences apply as explained in the Terms & Conditions for registered users.

13. Liability

The Platform is provided to Guests on an as-available basis. We are liable only as required by statutory provisions. We are not liable for Guest use of the Platform, User Content, external content, third-party services, interruptions, loss of data, device issues, network problems, inability to connect to the Platform, hardware/software damage, or interactions with other users.

Liability is excluded for slight negligence, except for damages to life, body, or health, or under the Product Liability Act.

Users are responsible for securing their data and devices.

14. Governing law and jurisdiction

These Guest Terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

Disputes fall under the exclusive jurisdiction of the courts of Graz, Austria.

For consumers, jurisdiction lies with the consumer’s residence, habitual residence, or workplace, per Austrian Consumer Protection Act.

15. Entire Agreement

These Terms constitute the entire agreement between you and us. Invalid provisions will be replaced with legally effective ones that come closest to the intended purpose. We do not accept any deviating terms unless explicitly agreed in writing.

16. Modifications to the Terms

We may amend these Terms from time to time. Amendments will be communicated by email at least four weeks in advance. Consent is deemed granted if you do not object before the effective date.
